Terms & Conditions – Tool Rental Agreement

Welcome to ProHire. By placing a rental order through our website, you ("Customer", "you") agree to be bound by the following Terms & Conditions. Please read them carefully before completing your booking.
1. Definitions
"ProHire", "we", "us", or "our" refers to ProHire, the tool and equipment rental service operated via this website. "Equipment" or "Tools" refers to any item listed for rental on our website, including but not limited to power tools, hand tools, construction equipment, garden tools, and related accessories. "Rental Period" means the agreed duration for which Equipment is hired, as confirmed at checkout.
2. Eligibility
You must be at least 18 years of age to rent Equipment from ProHire. By placing an order, you confirm that you are legally capable of entering into a binding agreement. We reserve the right to request valid photo identification before releasing any Equipment.
3. Rental Bookings & Payment
All rental bookings are subject to availability. Prices displayed on the website are in the applicable currency and include VAT unless stated otherwise. Full payment is required at the time of booking. We accept major credit and debit cards as well as other payment methods displayed at checkout. A security deposit may be required for certain items and will be specified on the product page. Deposits are refunded within 7 business days of the Equipment being returned in satisfactory condition.
4. Rental Period & Extensions
The Rental Period begins on the confirmed collection or delivery date and ends on the agreed return date. If you wish to extend your rental, you must notify us at least 24 hours before the scheduled return date. Extensions are subject to availability and additional charges at the prevailing daily rate. Late returns without prior agreement will incur a late fee equal to 150% of the standard daily rental rate for each additional day or part thereof.
5. Collection & Delivery
Equipment may be collected from our premises or delivered to your specified address, depending on the option selected at checkout. Delivery charges, where applicable, are displayed before payment. You are responsible for inspecting the Equipment upon collection or delivery. Any pre-existing damage or missing parts must be reported to us within 2 hours of receipt. Failure to report issues within this timeframe will result in you being held responsible for such damage.
6. Use of Equipment
You agree to use all Equipment solely for its intended purpose and in accordance with any manufacturer instructions or safety guidelines provided. You must not sublease, lend, or allow any unauthorised third party to use the Equipment. You must not modify, alter, or tamper with any Equipment. You are responsible for ensuring that anyone operating the Equipment is suitably trained and competent. Equipment must not be used for any unlawful purpose.
7. Care & Maintenance
You are responsible for the safekeeping and proper care of all rented Equipment for the entire Rental Period. This includes protecting Equipment from theft, weather damage, misuse, and neglect. You must keep the Equipment clean and return it in the same condition as received, allowing for reasonable wear and tear. You must not attempt any repairs yourself. If Equipment becomes faulty, contact us immediately.
8. Damage, Loss & Theft
You are fully liable for any loss, theft, or damage to the Equipment during the Rental Period, including damage caused by misuse, negligence, or failure to follow operating instructions. In the event of damage, we will charge the cost of repair or, if the Equipment is beyond economic repair, the full replacement value. In the event of theft or total loss, you will be charged the full replacement cost at current market value. You are strongly advised to arrange your own insurance to cover rented Equipment.
9. Returns
Equipment must be returned by the agreed return date and time, to the same location from which it was collected, or as otherwise arranged. All Equipment must be returned clean and in the condition it was received, subject to fair wear and tear. Fuel-powered Equipment must be returned with the same fuel level as at collection. Failure to return Equipment by the due date may result in late fees and, where applicable, legal action for recovery.
10. Cancellations & Refunds
You may cancel a booking free of charge up to 48 hours before the scheduled rental start date. Cancellations made between 24 and 48 hours before the rental start date will incur a cancellation fee of 25% of the total rental cost. Cancellations made less than 24 hours before the rental start date, or failure to collect the Equipment, will not be eligible for a refund. Once the Rental Period has commenced, no refund will be given for early returns. Refunds, where applicable, will be processed to the original payment method within 5-10 business days.
11. Limitation of Liability
ProHire shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Equipment. Our total liability shall not exceed the total rental fee paid for the relevant booking. We do not accept responsibility for any personal injury, property damage, or financial loss resulting from the use or misuse of rented Equipment, except where caused by our proven negligence. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
12. Indemnification
You agree to indemnify and hold ProHire, its owners, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Equipment, breach of these Terms, or violation of any applicable law.
13. Force Majeure
ProHire shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, or supply chain disruptions.
14. Privacy & Data Protection
We collect and process personal data in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your data as described therein.
15. Amendments
ProHire reserves the right to update or modify these Terms & Conditions at any time. Changes will take effect upon posting to this page. The version in effect at the time of your booking will apply to that rental. We encourage you to review these Terms periodically.
16. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the jurisdiction in which ProHire operates. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
